What is a T Visa and How Does it Work?

The T visa, established under the Victims of Trafficking and Violence Protection Act / Trafficking Victims Protection Act, exists to help people who have been victims of human trafficking, labor trafficking, harassment or abuse, labor difficulties, abusive employers, or unpaid work hours, giving them a legal way to stay and rebuild their lives in the United States.

For the T visa, it is not necessary to have agencies involved, investigations, or police reports — this is not a requirement. The person must have experienced some form of human trafficking or exploitation on their way to or within the United States (such as abuse at the border, by smugglers, during the crossing, or while working under coercive conditions), which usually does not involve filing police reports.

It also applies to people who have experienced some form of human trafficking on their way to the United States, abusive or dangerous work situations, like forced labor, physical abuse by employers, or even being yelled at or mistreated for being an immigrant. These cases can vary in severity — they do not need to involve only extreme or violent situations to qualify.

The T Visa Application Process

Preparing Your Application (Form I-914)

To start, you must submit Form I-914, known as the Application for T Nonimmigrant Status. Alongside this form, you need to write a personal statement that explains what you went through as a trafficking survivor. 

Provide Evidence of Eligibility - Trafficking or Labor Abuse

You must testify that you are or were a victim of trafficking in order to qualify for a T visa. Documentation showing harassment, threats, or retaliation can be used here if it exists. For example, text messages, emails, and voicemails can be helpful. 

Admissibility and Waivers

Sometimes, people do not qualify for status automatically because of something in their record that makes them “inadmissible.” This could include immigration or criminal issues. You can still ask the government to allow you to stay, but you’ll need to file Form I-192, which is an application for a special waiver.

The T visa allows survivors to work. Apply for work permission by sending Form I-765 under the (c)(40) category with your main application. If you turn in your I-765 right away, you can often start working faster. If you have family who also need support, only after your own status is approved can your relatives start to apply for work permits too.

The U Visa is for victims of qualifying crimes in the U.S. who suffered harm and must have law enforcement certification showing they were/are helpful. Both can lead to work authorization and, later, a green card, but the standards for cooperation and evidence requirements differ.
