Alonso & Alonso immigration attorneys smiling in a professional office setting, representing the FAQ and legal support section for clients seeking answers to their cases.

In thousands of cases we have handled, we have only seen two situations where an ICE officer was present at a biometrics appointment. In both cases, the client was already on ICE’s radar prior to the appointment due to a deportation order.

🚫 That is not true.

• They claim that VAWA is a fraud or that all applications are fake.

✅ VAWA is a legitimate federal law

• Created to protect individuals suffering from mistreatment/abuse.

• What is true is that there has been misuse by unlicensed individuals, attorneys who do not understand the requirements, and misinformation regarding what is considered “abuse” and how to prove it.

✅ Our evaluations are ethical, legal, and responsible.

• We do not promote fraud and only take on cases we know we can win.

• We reject cases that lack a sufficient basis to obtain favorable results.

• We have closed and refunded cases that, upon further investigation, did not have a sufficient basis.

🛡️ If someone is detained:
• Having a pending case is a positive factor.
• It is not an automatic guarantee of release.
• Each case depends on jurisdiction, history, and legal strategy.

Our team can:
• Evaluate the possibility of a bond, offer additional bond services, or refer to an attorney.
• Refer or coordinate habeas corpus if necessary.
• Guide the family on an emergency plan.

🚫 What we cannot do:
• Guarantee immediate release.
• Stop a deportation without a legal basis.
• Change political decisions with a phone call.

With this government, traveling can be risky
• Even with valid documents.
• Although the permit may be approved, the officer at the port of entry has discretion.

We have seen situations where people with valid permits face:
• Long interrogations
• Temporary detentions or attempts to question the legitimacy of the case without an attorney present.

It does not mean that everyone will be detained

It means the risk is higher than in previous years

At Alonso & Alonso we take to complete most applications between:

60 AND 90 DAYS

USCIS takes to make decisions depending on the case presented between:

2 AND 5 YEARS

🛡️ What we are seeing:

  • Delays in receipts
  • Slower processing
  • Internal reassignments at USCIS
  • Increased scrutiny in humanitarian cases

🚫

It does not mean your case is wrong

• It means the system is under pressure

✅ We continue to see approvals.
✅ We continue to see court terminations.
✅ We continue to see work permits.
Justice is not closed — it is slower.
