What is Family Immigration?

Family immigration is a process in the United States that allows people to bring specific family members from other countries to live here as lawful permanent residents. The basic idea comes from the belief that families should be together, even if members were born in different places. US citizens and, in many cases, Green Card holders, can ask for certain relatives to join them.

To become a lawful permanent resident in the U.S., a foreign national often needs a family-based immigrant visa. This visa is typically sponsored by either a U.S. citizen or a Green-Card holder who is at least 21. There are two family categories: Immediate Relative Petitions, for close, immediate family members of U.S. citizens such as spouses, parents, or unmarried minor children under 21, which does not have a waiting list; and Family Preference Visa, for other family members like siblings or married children, which offers a limited number of visas and can take much longer due to backlogs.

US citizens can sponsor their spouses, children, parents, and siblings. A Green-Card holder can only sponsor their spouse and unmarried children.

The process is not the same for everyone, and it’s essential to speak with a legal professional to figure out what process you need to follow. If you want to build a future in the United States with close relatives, learning the rules and the risks is extremely important.

Family-Based Immigration Services Our Law Office Handles

Dealing with any type of family-based immigration concern is overwhelming – we know what’s at stake and we want to make sure you get the help you need. Below are some of the key areas we support families in:

Marriage Green Cards & Visas (Including Same-Sex Marriage Green Cards)

Applying for a marriage Green Card isn’t just about filling out government forms and proving you got married. It means proving your marriage is real and understanding each step, from gathering evidence of your relationship to dealing with interviews with immigration officers. We work with both opposite-sex and same-sex couples. No matter your situation, we’ll help document your relationship and prepare you for what comes next.

Whether you’re trying to get your parents, children, or siblings into the United States, we know how important this is. Each type of petition has rules and wait times that can be hard to understand if you aren’t familiar with immigration law. We can walk families through the process and ensure all steps are followed.

Divorce doesn’t always mean your immigration process has to stop. If your marriage ends during a Green Card or visa case, your right to stay in the country depends on several different things. We review your situation and figure out if there’s a way we can keep you in the country if that’s what you want.

Adjustment of status lets many people living in the U.S. become lawful permanent residents without leaving the country. The rules change depending on your particular situation, so it’s important to work with a law firm that is familiar with the law and what steps to take. We explain what’s possible and walk you through the process.

Some applicants must finish or begin their cases abroad at a U.S. embassy or consulate. Scheduling an interview, gathering the correct papers, and preparing for local requirements can sometimes feel confusing and very frustrating. We help you take the proper steps so your case is not delayed or denied.

A spousal visa lets someone join their husband or wife in the United States after marriage. When the spouse arrives, they hold lawful permanent resident status, meaning they can work and travel right away. It usually takes a bit longer to get approval, but it avoids an extra step after entry.

Immigrants suffering abuse or mistreatment from a family member who is a U.S. citizen or lawful permanent resident may apply for legal status confidentially under the Violence Against Women Act (VAWA). This helps victims escape their abuser and some victims may qualify to obtain their legal permanent residency; without the abuser’s involvement. To succeed, they need to show they have the required family connection, lived with the abuser, experienced violence or severe cruelty, and have a good record.

A U-visa helps victims of certain crimes in the US obtain protection against deportation. Victims may qualify for a work permit. Adults can include their spouse and young, unmarried minor children. Victims who are children themselves may also include parents and siblings in some cases. After following the correct procedures, those granted U visa status eventually become eligible for permanent residence.

If you want to become a U.S. citizen, our team can guide you through each part of the process. We help handle the paperwork and deadlines, answer your legal questions, and prepare you for the citizenship interview. Our goal is to make sure you avoid common mistakes. We’re here to offer support so your family-based immigration pathway becomes clearer.

If you need help with any of these processes – or anything else at all – our immigration attorneys are here to help in any way we can.

The United States Family-Based Immigration Process

If you want to bring a relative to the United States or help a loved one gain lawful status, immigration law can feel confusing. That’s why working with a lawyer can make a difference. We guide you at every turn so that your family’s case moves forward with as few problems as possible. Here’s a brief overview of what the process might look like:

Eligibility and Initial Consultation

Before anything else, you need to check if you and your immediate family member qualify. This step isn’t always simple because the law is different for different categories of people. At our first meeting, we gather your details and explain what options apply to your situation.

Preparing Your Petition (I-130, I-485)

The process starts with paperwork. U.S. citizens and Green Card holders must file specific petitions, most often Form I-130 (Petition for Alien Relative), and sometimes Form I-485 (Application to Register Permanent Residence or Adjust Status) if the relative is already in the U.S. These forms tell the government you want your loved one to live here. Careful preparation of your application can prevent serious delays or requests for more evidence.

Adjustment of Status or Consular Processing

If your relative is already lawfully in the U.S., they may use an “Adjustment of Status” process. If they are outside the country, the next part happens at the U.S. consulate in their home country – this is “consular processing.” Each has its own process and set of timelines. We can help no matter where your loved one is located.

Approval and Family Reunification

Once USCIS approves your petition, your case moves to the National Visa Center, which begins gathering documents and getting everything ready before your interview at a U.S. embassy or consulate. The goal is to ensure your relative gets permission to live and work in the United States. The timing for approval depends on family relationships and wait times. We keep you informed about updates so you know when your family can plan to be together again.

Family Immigration Lawyer FAQs

How long does it take for family reunification to process?

Processing time depends on your relationship to the sponsor and where your case falls within the preference categories. U.S. citizens bringing an immediate relative (like a spouse, parent, or unmarried minor children) usually see a shorter wait time compared to some other more complex reliefs. Other scenarios, like seeking a family preference visa for siblings (fourth preference F4), married sons and daughters (third preference F3), spouses and unmarried children under 21 (second preference), or unmarried sons and daughters (over 21) of U.S. citizens (first preference), can take many years due to annual quotas and high demand.

How much does family-based immigration cost?

Legal and government fees vary by type of visa and number of relatives included. More complex cases or waivers increase the total. Every immigration goal is different, so please ask about our costs during the initial meeting for evaluation. We will always be open and upfront about fees before you decide to work with us.

Can I bring my parents or siblings to the U.S.?

U.S. citizens can file petitions for certain family members, including spouses, unmarried or married sons and daughters, siblings, and parents. However, family preference limits affect when these individuals can enter the country. Lawful permanent residents may file for spouses and unmarried children, but cannot directly petition for siblings or parents.

What if my family member has a criminal history?

Some issues can be overcome with waiver applications. Not all criminal history is a barrier to all applications for immigration status. We have extensive history in defending immigrants with criminal history. Our priority is helping families facing these barriers, and our attorneys can review your details and provide a personalized legal strategy.

Do you offer services in Spanish?

Yes, bilingual attorneys and staff are ready to serve you in Spanish and explain each legal step.

Can undocumented immigrants apply for family visas?

If you are undocumented, call or message us to speak with attorneys who can address your situation honestly. We help immigrants navigate obstacles around status and explore possible solutions with careful attention to eligibility.

Don’t let fear hold you back.
